The following Booking Conditions together with our Privacy Policy, and where your holiday is booked via our website, our Website Terms of Use, form the basis of your contract with Balkan Bird Bokeh. Please read them carefully as they set out our respective rights and obligations. Our office is in Bihacka 49, 26300 Vrsac. Our phone number is +381645554356 and our email address is office@balkanbirdbokeh.com.
In these Booking Conditions, ‘you’ and ‘your’ mean all persons named on the booking (including anyone who is added or substituted at a later date). ‘We’, ‘us’ and ‘our’ mean Balkan Bird Bokeh.
1. Making your booking
In order to make booking with us, the party leader must contact us and specify the wanted services. He/she must be authorised to make the booking on the basis of these Booking Conditions by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. We will then send you our offer, which contains agreed upon services, price and other information required. By accepting the offer, the party leader confirms that he/she is so authorised. The party leader consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements) The party leader is responsible for making all payments due to us. The party leader must be at least 18 when the booking is made. All bookings are subject to these Booking Conditions.
Once the party leader accepts our offer, we will send you deposit payment instructions based on your accepted offer. At this point, your booking will be held for 10 days while you make deposit payment. After we verify your deposit payment, we will issue your advance invoice and booking confirmation. If no payment is made within 10 days after payment instructions are sent, your booking is considered cancelled. We reserve the right to return your deposit payments and decline to issue a booking confirmation at our absolute discretion.
Bookings made by telephone will only be accepted after we have received verbal agreement by you to accept and abide by our Booking Conditions. Bookings made through our website will be confirmed once your payment has been verified. Once we have received your booking, we will, subject to availability, confirm your holiday by issuing a confirmation invoice which will include the details of your booking such as date, agreed upon services and packages, total cost, deposit amount, due amount and other information. A binding contract will only come into force between you and us once we have issued you with a confirmation invoice which will be sent to the party leader or your travel agent. Please check this invoice carefully as soon as you receive it.
The rest of amount due is either payable on spot, in Serbia, or via invoice.
2. Jurisdiction and Applicable Law
We both agree that Serbian Law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute is settled by the Courts of Serbia.
3. Cancellation by you before departure
You may cancel your booking at any stage, provided you do so in writing. Your notice of cancellation will only be effective when it is received in writing by us at our offices. Should one or more members of a party cancel, it may increase the per person holiday price of those still travelling and you will be liable to pay this increase. To protect yourself financially you should ensure that you have adequate travel insurance from the time of booking. As we incur costs from the time we confirm your booking the charges set out below will apply.

Cancellation by you due to Unavoidable & Extraordinary Circumstances: You have the right to cancel your confirmed holiday before departure without paying a cancellation charge in the event of “unavoidable and extraordinary circumstances” occurring in our country, Serbia. In these circumstances, we shall provide you with a full refund of the monies you have paid but we will not be liable to pay you any additional compensation.
4. Changes by you & Transfers of Booking
Should you wish to make any changes to your confirmed holiday, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.
Transfer of booking
If you or any member of your party is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions:
- That person is introduced by you and satisfies all the conditions applicable to the holiday;
- The transferee agrees to these booking conditions and all other terms of the contract between us. You and the transferee remain jointly and severally liable for payment of all sums.
Cutting your holiday short
If you are forced to return home early, or if you cut short your holiday and return home early in circumstances where you have no reasonable cause for complaint about the standard of accommodation and services provided, we will not offer you any refund for that part of your holiday not completed, nor be liable for any associated costs you may incur. Depending on the circumstances, your travel insurance may offer cover for curtailment and we suggest that any claim is made directly with them.
5. Changes and cancellation by us
In general, since we are local tour operators, cancellations by us are going to be a rare occurrence.
In case of it happening you are entitled to full refund of your booked holiday. If we have to make some changes in the dates of the booked holiday, we will inform you as soon as possible. If you are unable to come for your holiday due to these changes brought by us, you are entitled to a full refund.
6. Force majeure
Except where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay any compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as a pandemic, or outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority, including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or our supplier’s control.
7. The cost of your holiday
We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. We also reserve the right to correct errors in the prices of confirmed holidays.
Prices are fixed upon booking. However, for tours booked more than 150 days in advance, any price adjustments due to inflation, increased operational costs, or supplier price changes will be communicated at least 150 days prior to departure. In such cases, clients may cancel with a full refund. Furthermore, we pledge to let you know of any price changes 150 days in advance, unless in the case of Force majeure( Unavoidable and Extraordinary Circumstances).
8. Insurance
We strongly suggest all clients to have valid travel insurance covering medical emergencies, trip cancellations, and personal liability. We are not liable for any of costs, damages and expenses which are usually covered by insurance.
9. Behaviour
We expect all clients to have consideration for other people. All our customers are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in our opinion or in the opinion, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other customers or any third party, or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking with us immediately. In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave arrangements immediately. We will have no further obligations to you and/or your party. No refunds for lost arrangements will be made and we will not pay any expenses or costs incurred as a result of termination. This means that person or persons causing distress will be removed immediately from the photography premises. In such case, no refunds will be issued, and the client will be responsible for their own travel arrangements and costs and expenses from that point forward.
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid directly at the time to us, or in case of damage to the third party, to the said third parties. We can not be held liable for the behaviour of our clients.
We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.
10. Our liability to you
- We will accept responsibility for the arrangements we agree to provide or arrange for you as an “organiser” and as such, we are responsible for the proper provision of all travel services included in your package, as set out in your invoice. Subject to these Booking Conditions, if we or our suppliers negligently perform or arrange those services and we don’t remedy or resolve your complaint within a reasonable period of time, and this has affected the enjoyment of your package holiday you may be entitled to an appropriate price reduction. You must inform us without undue delay of any failure to perform or improper performance of the travel services included in this package.
- We will not be responsible or pay you compensation for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:
– the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party;
– the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unavoidable and extraordinary;
– Force Majeure (as defined in clause 6). - Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you.
- Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.
- Please note, we cannot guarantee that you will see a certain kind of bird or other wildlife. We will take you to the spots where there is a highest chance, to the best of our knowledge, in the area to see and photograph desired and agreed upon wildlife. As such, this can not be the basis of reduction of price of service. Furthermore, we are dealing with alive, wild animals and we can not guarantee that the specific animals will be at hide/tent hide or any other location we take you to observe and/or photograph said wildlife. Additionally, sometimes the wildlife perishes or leaves the pre-selected spot for photography (for example snake enters the nest and eats the fledglings). In such cases you will be taken to some other hide or tent hide in agreement with us so you can continue with your holiday. We are under no obligation to reduce the price of holiday or refund the money already paid under such conditions.
- We do not assume responsibility for the performance, reliability, or availability of any third-party services, including accommodations, external transport providers, or local excursions not organized directly by Balkan Bird Bokeh.
11. Excursions, activities and website information
Aside from guiding you to bird hides for bird photography and bird watching we do organize some local excursions (such as Hedonists trail). For these activities and excursions the same terms and conditions apply.
The information contained on our website is correct to the best of our knowledge at the time of the publishing. We may provide you with information (on our website and/or when you are on holiday in person) about activities and excursions which are available in the area you are visiting but not run by us.
We have no involvement in any such activities or excursions which are neither run, supervised nor controlled in any way by us. They are provided by local operators or other third parties who are entirely independent of us. They do not form any part of your contract with us even where we suggest particular operators/other third parties and/or assist you in booking such activities or excursions in any way. We cannot accept any liability on any basis in relation to such activities or excursions and our acceptance of liability will not apply to them.
We cannot guarantee accuracy at all times of information given in relation to such activities or excursions or about the resorts/area you are visiting generally (except where this concerns the services which will form part of your contract) or that any particular excursion or activity which does not form part of our contract will take place as these services are not under our control. If you feel that any of the activities mentioned on our website which are not part of our contract are vital to the enjoyment of your holiday, write to us immediately and we will tell you the latest known situation. If we become aware of any material alterations to resort/area information and/or such outside activities which can reasonably be expected to affect your decision to book a holiday with us, we will pass on this information at the time of booking.
12. Delay or Missed Transport Arrangements
If you or any member of your party misses your flight or other transport arrangement, it is cancelled or you are subject to a delay of over 1 hour for any reason, you must contact us or other transport supplier concerned immediately.
In case of purchase transfer arrangements from us, in case of any delay (such as delayed flight), inform us immediately.
In case of purchase transfer arrangements from us, we reserve the right to charge additional fees which come out as because of the delays. We cannot accept liability for any delays, which are out of our control and due to any of the reasons set out in clause 6 of these Booking Conditions (which includes the behaviour of any passenger(s) on any flight who, for example, fail(s) to check in or board on time). On the other hand, we are willing to offer a grace period of 30 minutes, where the client will not be charged any additional fees. After that period additional charges which stem from delays will be charged to the client.
In case of a missed transfer the client must pay for a new transfer.
However, if client lets us know that he or she will be late within a reasonable timeframe (at least 3 hours before arrival) due to factors outside of his or her control we will provide free rescheduling.
13. Prompt Assistance in Resort
If, whilst you are on holiday, you find yourself in difficulty for any reason, we will offer you such prompt assistance as is appropriate in the circumstances. In particular, we will provide you with appropriate information on health services, local authorities , assistance with distance communications and finding alternative travel arrangements. Where you require assistance which is not owing to any failure by us, our employees or subcontractors, we will not be liable for the costs of any alternative travel arrangements or other such assistance you require. Any supplier, airline or other transport supplier may however pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these Booking Conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances, if you fail to obtain our prior authorisation before making your own travel arrangements. Furthermore, we reserve the right to charge you a fee for our assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through your or your party’s negligence.
